WILDBIRD TERMS AND CONDITIONS

By procuring any product from WildBird, you signify your unequivocal acceptance of and adherence to the terms and conditions herein.

RETURN AND EXCHANGE POLICY

Goods may be returned within 30 days or exchanged within 60 days of the confirmed delivery date, provided they remain in an unsullied condition. Refunds will be processed upon receipt and inspection of the returned item(s). WildBird disclaims responsibility for return packages lost in transit.

Seconds: Items classified as "Seconds" are final sales. A disclosure will precede any payment for such products, indicating their ineligibility for return or exchange.

PERSONAL DATA PROTECTION

WildBird commits to exercising due diligence in preserving the confidentiality of personal data provided. This data is solely for facilitating deliveries and communication of promotional content. Disclosure to third parties is categorically excluded. All transactions undergo rigorous encryption protocols for optimal security. Payments are orchestrated via Shopify.

PAYMENT TERMS

Goods remain the unequivocal property of WildBird pending full settlement of any outstanding amounts. The prevailing price at the time of the order placement is conclusive. All ancillary costs, including shipping, sales tax, and transaction fees, will be transparently disclosed prior to finalizing the purchase.

WildBird utilizes SSL encryption for credit card transactions. We expressly reserve the right to initiate legal proceedings against defaulters and to duly notify affiliated entities of such breaches.

Patrons are enjoined to review the terms of their chosen payment gateway, as they assume ultimate responsibility for the transactions executed.

SHIPPING AND DELIVERY

WildBird ensures the ultimate delivery of all orders unless obstructed by inaccuracies in the address provided. In such instances, our team will assist in initiating a claim with the designated carrier.

Delivery timelines are estimative and may be affected by factors beyond our control, including but not limited to carrier delays, customs, holidays, and force majeure events.

INTERNATIONAL ORDERS may be subjected to unforeseeable delays. Any local or international levies, such as sales tax or customs duties, shall be borne by the customer.

HOLIDAY SHIPPING: Patrons are advised to anticipate extended delivery times between November 25 and December 25.

SALES AND PRODUCT LAUNCHES

During promotional periods, processing times may be extended. Discounts introduced post-purchase will not be retroactively applied.

SECONDS

Items designated as "Seconds" may bear minor cosmetic discrepancies that do not compromise their functionality or safety. Such items are invariably categorized as final sales.

MODIFICATION AND CANCELLATION RIGHTS

WildBird retains the prerogative to modify any stipulated information or to nullify any order, with an ensuing full refund to the patron.

PRODUCT WARRANTY

WildBird offers a one-year warranty against manufacturing defects for all baby-wearing products and a 60-day warranty for all other items. This warranty is exclusive to the original purchaser and does not encompass regular wear and tear or external damage.

PRODUCT DISCLOSURES

WildBird’s linen products, being of natural origin, may manifest minor variations. Adherence to our recommended care guidelines is essential.

LIMITATION OF LIABILITY

To the maximum extent permissible by law, WildBird disclaims liability for any consequential, incidental, indirect, punitive, or special damages, including loss of revenue or profits, data, goodwill, or other intangible losses, arising from the use or inability to use our products.

SAFETY RECOMMENDATIONS

Patrons are implored to meticulously review and comply with safety guidelines accompanying products. WildBird disavows liability for injuries, death or damages resulting from misuse, neglect, or deviation from stipulated instructions.

INTELLECTUAL PROPERTY PROTECTION

The WildBird™ name and logos are registered trademarks with the USPTO and are therefore not reusable, and cannot be reproduced in any way or manner. WildBird, LLC intellectual property includes... "Keep Your Little Bird Close™" "Happy Place For Your Little Bird(s)™" "Seed To Sling™" "In The Know™" "Aerial Carrier™" and it's pending US and International design and utility patents; US 63/400,602, US 29/850,966 "CloudBlend™". All logos, trademarks, and specific phrases listed herein are the proprietary assets of WildBird and are shielded by law. Unauthorized reproduction or usage is strictly prohibited.

GOVERNING LAW AND JURISDICTION

All matters arising from these terms shall be governed by the laws of Utah, with exclusive jurisdiction vested in the courts of Salt Lake City, Utah.

SEVERABILITY

If any provision herein is adjudged unenforceable or invalid, the remaining provisions shall remain in full force and effect.

MODIFICATIONS TO TERMS

WildBird reserves the right to modify these terms at its discretion.
